LEGAL CONTRACTYou must be old enough to enter into a binding legal obligation. These Terms and Conditions are a binding Agreement between you and MobileSky. By using our service you represent that you are old enough to enter into a legal obligation and are agreeing to these Terms and Conditions. You also agree to ensure that anyone who uses this software on your computer also abides by the Terms of Use. DESCRIPTION OF SERVICEMobileSky offers the ability to remotely delete as well as synchronized your mobile phones with a central server operated by MobileSky. The remote delete feature enables (a) delete all selected content on a mobile device from MobileSky.com or MobileSky call center, (b) disable the selected device from unauthorized access. The backup and restore service enables (a) to manage content on a mobile device from MobileSky.com, (b) create a backup of the content and restore this to new mobiles - collectively the "Service". These services are subject to a monthly charge. MobileSky can change which services that are charged for with a 30 days notice announced in a clearly visible place at MobileSky.com. COPYRIGHT AND TRADEMARKSMobileSky respects the intellectual property of others, and we ask our users to do the same. MobileSky may, in appropriate circumstances and in its sole judgment, terminate the accounts of users who violate the intellectual property rights of others. All the texts, designs and web pages etc. (collectively "Content") contained in the MobileSky service is copyrighted as a collective work under the laws in force in Canada, and MobileSky owns a copyright in the selection, coordination, arrangement and enhancement of such Content. The MobileSky service, name and logo are trademarks of MobileSky. All other trademarks that appear within the MobileSky service are trademarks of their respective owners. Partners of MobileSky may also have supplementary proprietary rights in the content that they offer through the service. You may not change, publish, transmit, partake in the transfer or sale, create imitative works, or in any way exploit, any of the Content, in whole or in part. Service made available by MobileSky, including any files, images incorporated in or generated by the service, and data accompanying the service (collectively, the "Service") are licensed to you by MobileSky pursuant to a license agreement governing the Service. MobileSky does not transfer title to the Service to you. You may not redistribute, sell, decompile, reverse engineer, disassemble, or in any other way reduce the Service to a human-readable form. THIRD PARTY INFORMATIONThe MobileSky service may provide content from MobileSky partners, search results or links to other World Wide Web sites or resources. Because MobileSky has no control over such sites and resources, you acknowledge and agree that MobileSky is not responsible for the availability of such external sites or resources, and does not support and is not responsible or legally responsible for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that MobileSky shall not be directly or indirectly responsible or liable for any damage or loss caused or assumed to be caused by or in relation with use of or reliance on any such content, goods or services accessible on or through any such site or resource. |
